Before we started applying it to the machines that do most of the heavy lifting in office work, the term “computer” referred to people who performed mathematical calculations. For example, the protagonists of the movie Hidden Figures worked as computers; their work consisted of solving mathematical equations to corroborate the answers that their coworkers had found to those same equations. The machines that we know as computers think in numbers; their ability to interpret and produce text, images, audio, and video is simply elaborate overtones of their computational functions. Today, the ability of machines to communicate in human language ranges from amazing to dystopian. It is easy, and dangerous, to feel that a chatbot is your friend, and yet numerous people have had this experience. Chatbots make excellent inferences about what constitutes a plausible response, from a linguistic perspective, to your input, but they cannot fathom what the real-world consequences of your conversation will be. You might expect that, in their capacity to express the content of spreadsheets in a conversational manner, they would perform better as financial advisers than they do as marriage counselors or telehealth physicians, but you would be wrong. The human element is more important than you think in helping people solve their financial problems. Chatbots Don’t Have a Fiduciary Duty to the Humans That Seek Their Guidance

Fiduciary duty is when you entrust someone with your money, and that person has a legal duty to act in your best interest. Banks have a fiduciary duty toward their customers; consider that, if you try to withdraw money from your bank account, it would be illegal for the bank to say, “Sorry, your money isn’t here anymore. We spent it building an Olympic pool-sized aquarium to house South Florida’s largest captive axolotl population.” The same duty applies when financial advisers counsel their clients about investing and borrowing. When it comes to predatory lending, the courts decide on a case-by-case basis how unethical a lender’s actions must be to become illegal; it seems like lenders frequently get away with capitalizing on people’s financial desperation, but consumers have recourse to lawsuits, and regulators sometimes try to curb predatory lending practices.

A chatbot is accountable to no one when it gives you bad advice about spending and borrowing. When it advises you to skip payments on your bills, and you listen, you can’t complain to its boss, refuse to pay it for its irresponsible service, or sue it for damages, not unless you join a class action lawsuit against one of the makers of chatbots.
